Alienation of Affection

Alienation of Affection is a cause of action recognized in North Carolina that permits a spouse to pursue a civil lawsuit against a third party who wrongfully interfered with the marital relationship. The claim is based on the premise that an outside individual’s intentional conduct contributed to the loss of love, companionship, and affection within the marriage.

These cases generally arise when a third party engages in behavior that disrupts an otherwise intact marital relationship and ultimately contributes to its deterioration. Unlike divorce proceedings, which resolve issues between spouses, an Alienation of Affection claim focuses on the conduct of the outside individual whose actions allegedly caused harm to the marriage.

To prevail, a plaintiff must demonstrate:

  • A valid marriage in which genuine love and affection existed between the spouses;
  • A loss or destruction of that love and affection; and
  • A causal connection between the third party’s wrongful conduct and the breakdown of the marital relationship.

Because these claims are highly fact-specific and often vigorously contested, careful legal analysis and strategic case development are critical.

Criminal Conversation

Despite its name, Criminal Conversation is not a criminal offense. It is a civil claim recognized under North Carolina law that allows a spouse to bring a lawsuit against a third party who engaged in sexual relations with their spouse during the marriage.

To establish a claim for Criminal Conversation, a plaintiff must prove:

  • A legally valid marriage existed at the time of the conduct; and
  • Sexual intercourse occurred between the defendant and the plaintiff’s spouse during that marriage.

Direct proof of the relationship is not required. Courts permit the use of circumstantial evidence to establish that sexual relations took place.
